GENERAL

United States Rowing Association (“USRowing,” “we,” or “us”) is committed to protecting your privacy and complying with the applicable privacy laws related to the information we collect from you. This Privacy Policy describes how we collect, use, share, and protect your information. This Privacy Policy also describes the choices you have regarding the information USRowing collects, including how you can manage, update, or request to delete information. By accessing and using the resources listed in Section III, you accept and agree to this Privacy Policy without limitation or qualification. If you do not agree with these terms, you should not use the Site or any related USRowing applications, website, platform, or other software or technology products. Your continued use of our Site after we make changes is deemed to be acceptance of those changes, so please check this Privacy Policy periodically for updates.

WHEN DOES OUR PRIVACY POLICY APPLY

This Privacy Policy describes the types of information we may collect from you when you visit or use our Site or any components of our Site, and when we communicate with you electronically, such as through our Site, email, text message and other electronic messages between USRowing and you.

WHEN DOES OUR PRIVACY POLICY NOT APPLY

This Privacy Policy does not apply to information collected about you offline, through sites such as online shops or donation platforms that display different privacy policies, or through your interactions with USRowing employees or contractors outside of the Site or applications (such as via telephone or email). 

We reserve the right to modify this Privacy Policy at any time and will notify you by changing the “Updated” date above. Please review this Privacy Policy periodically to keep up to date on our most current policies and practices.

THE INFORMATION WE COLLECT

USRowing is the sole owner of the information collected on our platform. We only have access to/collect information that you voluntarily submit to us via online registration forms, email, or other direct contact from you. We will use your information to respond to you or deliver the products or services related to the reason for engagement. 

In the normal course of USRowing’s activities we collect the following types of identifiable information:

  • Name;
  • E-mail address;
  • Date of birth;
  • Mailing address;
  • Mobile phone number;
  • Credit card and Automated Clearing House (ACH) information;
  • Demographic information; and
  • Additional information described at the point of collection.

HOW WE COLLECT YOUR PERSONAL INFORMATION

What is Personal Information?

Personal Information is information that you provide to us which personally identifies you, such as your name, email address, or billing information, or other data that can be reasonably linked to such information by USRowing, such as information we associate with your USRowing account.

What types of Personal Information do we collect?

We collect and use Personal Information in order to operate and provide our Site to you, including our Products. You may provide Personal Information to us, and we may collect Personal Information from you automatically as you use and navigate through our Site.

How do we collect your Personal Information?

Information you provide to us. You may provide Personal Information to us through our Site. For example, you may be able to register to use our Site or create an account with us, which allows or requires you to provide certain information to us (e.g., contact information such as your name, email address, telephone number, etc.). You provide Personal Information and other information to us when you contact us through our Site.

When you purchase Products or Services. You can purchase Products or Services, or make payments to us, through our Site. In these situations, we collect your credit card, debit card or other payment card information or bank or other financial account information. We use third-party payment processors to collect and process your payment information. We require these third parties to agree to protect your Personal Information in a manner consistent with this Privacy Policy.

When you post content to our Site. You may also be able to add, post or upload comments, social media content, or other materials to our Site on public areas of the Site, or transmitted to other users of the Site or to third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we may limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Site with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Information we collect automatically as you use our Site. We collect Personal Information and information automatically about the computers, devices, browsers and your Internet activity as you use and interact with our Site. The information we collect typically includes Unique Identifiers, browser type and settings, device types and settings, operating system, mobile network information including carrier name and phone number, and application version number. We also collect information about the interaction of your browsers and devices with our Site, such as IP address, device type, system activity, wireless carrier name (when you use a wireless or mobile device), and the date, time, and referrer URL of your request.

Online Activity. We collect information about your activity on our Site, Internet, network, and other online activity information, such as browsing history, search history, and information regarding your interaction with our Site and other websites. We use various technologies to collect and store location information, including cookies, pixels or pixel tags, local storage, such as browser web storage or application data caches, databases, session replay, and server logs.

Location. We collect information about your location when you use our Site, which helps us provide our Site Services, features and functionality. Your location can be determined with varying degrees of accuracy by:

  • GPS
  • IP address
  • Sensor data from your device
  • Information about things near your device, such as Wi-Fi access points, cell towers, and Bluetooth-enabled devices

The types of location data we collect depend in part on your device and account settings. For example, you can turn your mobile device’s location on or off using the device’s settings app. You may also be able to turn on location history if you want to create a private map of where you go with your devices.

Third-Party Sources. In some circumstances, USRowing also collects information about you from publicly-accessible sources. We may collect information about you from trusted partners, such as marketing partners who provide us with information about our potential customers, and security partners who provide us with information to protect against fraud and abuse of our Site.

HOW WE USE THE INFORMATION WE COLLECT

USRowing uses your information for the following business purposes:

  • to provide the services you request;
  • to respond to inquiries, we receive from you or in connection with a transaction you initiate;
  • to provide critical information regarding your membership including voting/election information, Safe Sport information, and other compliance and transactional information;
  • to analyze, manage, and improve the Site;
  • to use within USRowing to improve our organization and member experience;
  • to notify you of special events, offers, and services that we believe may be of interest to you;
  • to send you current mailings;
  • to provide you with targeted advertisements about goods, services, and events that may be of interest to you;
  • to help us diagnose problems with our server or other technical issues relating to performance;
  • to third parties engaged by USRowing to provide services such as administering USRowing websites and services available to you, subject to appropriate protections
  • As required by law or to protect our rights and property with third parties, including but not limited to:
    • Complying with a subpoena or other legal process requests,
    • Protecting your safety or the safety of others,
    • Investigating fraud or violation of our terms of use or other contract, and
    • Responding to a valid government request or subpoena.
    • For public health activities and purposes, such as contagious disease reporting, investigation or surveillance, and notices to and from our governing bodies;
    • For health oversight activities, such as licensing, audits, investigations, and inspections;
  • To avert a serious threat to your health and safety or the health or safety of another person pursuant to applicable law;
  • For law enforcement purposes, such as to provide information about someone who is or was suspected to be a victim of a crime or to report information about a crime, or to a correctional institution in certain circumstances;
  • For specialized government functions, such as for lawful national intelligence purposes or military purposes;
  • Disclosures authorized by an applicable workers’ compensation program; or
  • for any other specific purpose stated at the time you provide your information.

Provide our Site and Related Services. We use your Personal Information to operate, maintain, supervise, administer, improve, and enhance our Site and related Services, features and functionality. We use your contact information to communicate and interact with you, such as to send you emails and text messages about our Site. We use the IP address assigned to your device to send you the data you request to display on your device. We use unique identifiers stored in cookies on your device to help us authenticate you as the person who should have access to certain areas and features of our Site. We also use your information to ensure our Site is working as intended, such as tracking outages or troubleshooting issues that you report to us. And we use your information for research and development for our business, and to make improvements to our Site.

Analyze Use of the Site.We use data collected from you and your devices for analytics and measurement to understand how our Site is used. For example, we analyze data about your use of our Site to accomplish tasks such as optimizing our Product designs. We use a variety of tools to do this, such as Google Analytics and similar third-party online data analytics services.

Personal Information Provided by Third Parties. We may use Personal Information collected automatically and associate it with Personal Information we collect in other ways or receive from third parties. It helps us to improve our Site and to deliver a better and more personalized service by enabling us to:

  • estimate our audience size and usage patterns;
  • store information about your preferences;
  • customize our Site according to your individual interests;
  • speed up your searches; and
  • recognize you when you return to our Site.

Purchase Products or Services from Us. When you purchase Products from us, you may provide us information such as your payment card or bank account information, shipping address or delivery instructions. We use this information for things such as processing, fulfilling, and delivering your order, and to provide support in connection with the Products or Services you purchase.

Security and Legal Purposes. We use your information to help improve the safety and reliability of our Site. This includes detecting, preventing, and responding to fraud, abuse, security risks, and technical issues that could harm USRowing, our users, or the public. Information may also be used in connection for legal reasons and purposes, such as to comply with applicable law, regulation, legal process, or enforceable governmental request; to enforce our Terms of Use, including investigation of potential violations; and to detect, prevent, or otherwise address fraud, security, or technical issues; and to protect against harm to the rights, property or safety of USRowing, our users, or the public as required or permitted by law.

Advertising and Marketing. We may also use your information to contact you about our Products, as well as products and services offered by third parties that may be of interest to you. Please contact us using the Contact Information at the end of this Policy or use the Contact Us page of our Site if you would like to opt out or change your preferences with respect to receiving advertising and marketing communications from us.

WHY AND HOW WE SHARE YOUR PERSONAL INFORMATION

We share Personal Information with third parties under certain circumstances and for certain purposes described throughout this Policy, including:

Service providers and others to operate our Site and Services. We share your Personal Information with our affiliates, vendors, service providers, and business partners, including providers and vendors we use for operating and maintaining our Site, and its features, functionality and Services. These third parties include data hosting and data storage partners, analytics, ad network, advertising, technology services and support, and data security. We contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.

Our business purposes. We may share your Personal Information with our affiliates, vendors, service providers, and business partners, including providers and vendors we use for our business activities and operations generally, such as data hosting and data storage partners, analytics, ad network, advertising, technology services and support, and data security. We may also share your Personal Information with professional advisors, such as auditors, law firms, and accounting firms.

Third Party Marketing. Third parties to market their products or services to you. We contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them. Please contact us using the Contact Information at the end of this Policy or use the Contact Us page of our Site if you would like to opt out or change your preferences with respect to our sharing of PI for third-party marketing and advertising.

Affiliates. We may share your Personal Information with our subsidiaries and affiliates.

Compliance with law. We may share your Personal Information to comply with applicable law or any obligations thereunder, including cooperation with law enforcement, judicial orders, subpoenas, and regulatory inquiries.

To Enforce our Rights. We may share your Personal Information to enforce our Terms of Use and any other agreement, terms and conditions relating to your use of the Site. We also may share information as needed to ensure the safety and security of our Site and our users, and to detect, prevent, or otherwise address fraud, security, or technical issues

Protect Rights, Property and Safety. If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of USRowing, our customers, or others. This may include exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Business transfers. We may share your Personal Information to a buyer, potential buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of a bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about our users are among the assets transferred.

De-identified information. We may also de-identified information, so that it cannot be reasonably used to identify any individual, with third parties for marketing, advertising, research, or similar purposes.

Knowledge and Consent. With your consent, pursuant to your instructions, to fulfill a purpose for which you provide the information to us, and for any other purpose disclosed by us when you provide the information.

DATA SECURITY

Security Measures. We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Site like message boards. The information you share in public areas may be viewed by any user of the Site.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Site. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures deployed on the Site.

Consent to Processing of Personal Information in the United States. In order to provide our Site, products, and services to you, we may send and store your Personal Information outside of the country where you reside or are located, including to countries that may not or do not provide an equivalent level of protection for your Personal Information. Your Personal Information may be processed and stored in the United States and federal, state, and local governments, courts, or law enforcement or regulatory agencies in the United States may be able to obtain disclosure of your information through the laws of the United States. By using our Site, you represent that you have read and understood the above and hereby consent to the storage and processing of Personal Information outside the country where you reside or are located, including in the United States.

Your Personal Information is transferred by USRowing to another country only if it is required or permitted under applicable data protection law and provided that there are appropriate safeguards in place to protect your Personal Information. To ensure your Personal Information is treated in accordance with this Privacy Policy when we transfer it to a third party, USRowing uses Data Protection Agreements between USRowing and all other recipients of your Personal Information.

HOW TO ACCESS YOUR PERSONAL INFORMATION HELD BY US

You have the right to request:

Access, Corrections and Deletion. Please contact us using the Contact Information at the end of this Policy or use the Contact Us page of our Site if you have any questions regarding reviewing, accessing, correcting or deleting your Personal Information. Please promptly inform us of any changes or errors in any Personal Information we have about you to ensure that it is complete, accurate, and as current as possible. You may also have certain deletion rights in accordance with applicable law. We may not be able to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect.

User Contributions. If you delete your User Contributions from the Site, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other Site users. Proper access and use of information provided on the Site, including User Contributions, is governed by our Terms of Use.

Copies and Retention of Personal Information. Please contact us using the Contact Information at the end of this Policy or use the Contact Us page of our Site if you have any questions about obtaining copies or the retention of your Personal Information. Please promptly inform us of any changes or errors in any Personal Information we have about you to ensure that it is complete, accurate, and as current as possible. You may also have certain deletion rights in accordance with applicable law. We may not be able to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect.

Exporting Data. If you need to export or a copy of your data, please let us know and we will assist you with your request. We retain the data we collect for different periods of time depending on what it is, how we use it and applicable legal requirements. We may retain some data for longer periods of time than other data when necessary for legitimate business or legal purposes, such as security, fraud and abuse prevention, or financial record-keeping.

These rights are not absolute. Where we have obtained your consent for the processing of your personal information, you have the right to withdraw your consent at any time.

HOW TO OPT-OUT OF PROMOTIONAL COMMUNICATIONS

Site users may OPT-OUT of:

  • receiving mail, e-mail, and/or phone calls from USRowing with respect to USRowing, its member organizations, and their respective products, services, and upcoming events;
  • receiving information, advertising and promotional materials from third parties via mail.

You may OPT-OUT of any such use of your personal information by:

  • using one of the methods described in the CONTACTING US section of this Privacy Policy; or
  • with respect to personal information, you have provided in connection with a purchase from our online store, following the OPT-OUT procedures identified in, or linked to, your order form.
  • Some communications are required as a part of your membership with USRowing. 
  • Users who are members may NOT OPT-OUT of transactional information and compliance requirements, e.g. Safe Sport compliance. Site users may OPT-IN to receiving information, advertising, and promotional materials from third parties via e-mail by using one of the methods described in the CONTACTING US section of this PRIVACY POLICY.

USE OF COOKIES

We also may use certain standard web measurement and tracking technologies such as “cookies,” web server logs, or other statistics programs to collect usage information and track and record how you use the Site. Where our Site offers shopping, we may use cookies to keep track of items in your shopping cart. As you will see, third parties such as USRowing sponsors display logos and advertisements on the Site. These advertisements also may contain cookies. The use of advertising cookies sent by third-party servers is standard in the Internet industry. USRowing does not control, or have any responsibility with respect to, these third-party cookies. This data is anonymous and does not personally identify you. Usage information helps us measure the success of the Site and its features or pages, as well as improve your online experience. Your browser may have an option that allows you to accept cookies, reject cookies, or receive notification when a cookie is sent, but you should note that the use of such restrictive browser settings may limit your use of the Site.

In addition, we may utilize web beacons (also known as “action tags” or “one pixel .gif files”) to recognize you when you visit the Site. We do not use spyware, adware, or any other similarly intrusive software. We also may use other technology, called clear GIFs, to provide us with other important anonymous information, such as when an e-mail has been opened.

USE OF IP ADDRESSES

An IP address is a number that is automatically assigned to your computer whenever you're surfing the web. Web servers, the big computers that "serve up" web pages, automatically identify your computer by its IP address.

When a user accesses web pages on our Site, our servers automatically log the user's IP address. USRowing uses IP addresses for the purposes of system administration, auditing the use of the Site, and reporting aggregate information with respect to Site users to third parties. We do not normally link IP addresses to any information that personally identifies the user, meaning that the user remains anonymous to us. However, we will use IP addresses to determine the identity of a specific user: (a) as is required by law; (b) to comply with legal process; (c) to investigate claims with respect to use of the Site; and (d) as is reasonably necessary to protect the interests, rights, or property of USRowing, its member organizations, or others.

Notwithstanding the foregoing, some services within the Site, such as message boards, may display a user's IP address along with his or her username and message. If you choose to take advantage of such services, you acknowledge and agree that you have voluntarily provided to us information that causes your IP address to link to personally identifying information, and that our obligations with respect to use and disclosure shall be the same as those that apply to any other personal information that you have voluntarily provided to us.

LINKED SITES

Our Site may contain links to other websites, including social media sites, which may have privacy policies that differ from our own. We are not responsible for the collection, use, or disclosure of information collected through third-party websites and expressly disclaim any liability related to such collection, use, or disclosure. We are not responsible for any information or content contained on such sites. Links to other websites are provided solely as a convenience. Your browsing, use, and interaction on any other websites, including websites which have a link to the Site, are subject to that website's own rules and policies. Please review the privacy policy posted on any website that you may access through, or which links to, the Site.

Please note that if you provide information to us via a social media site or participate in a social media site linked to the Site, you consent to our use of your information for any reason as if it were submitted to us directly via the Site.

USROWING FOUNDATION

When USRowing receives your personal information, we use that information to improve our services, personalize your experience and for the other purposes described in this Privacy Policy. In some cases, this involves sharing personal information with our partners. The USRowing Foundation, an organization dedicated to raising funds to support USRowing, is one such partner. If you do not wish your personal information to be shared with the USRowing Foundation, you may opt out by contacting USRowing.

POLICIES WITH RESPECT TO CHILDREN

All children under the age of 18 are prohibited from registering for their own accounts, using the Site in any way, or providing personal information on or through the Site. For the purposes of this section, “personal information” includes, but is not limited to, the child’s name, address, telephone number, email address, screen name or user name. If a child under the age of 18 desires to have an account on the Site, the child’s parent or guardian must register for an account on the child’s behalf, provide any personal information on the child’s behalf, and continue to manage the account on the child’s behalf until the child reaches 18 years of age. As is further explained in the USE OF IP ADDRESSES section of this Privacy Policy, USRowing does not link the IP addresses of Site users to personal information other than in specified circumstances. As is further explained in the USE OF COOKIES section of this Privacy Policy, USRowing does use cookies on its Site, but such cookies are not linked to personal information unless such personal information is voluntarily provided to us via the Site. 

USRowing will not disclose personally identifiable information about children under the age of 18 without receiving verifiable consent from the child’s parent or guardian. Occasionally, USRowing may seek parental consent to disclose children’s names, such as for honor rolls or event results, or to identify Elite Athletes. USRowing will only disclose such information once parental consent has been received. 

INTERNATIONAL USERS

The Site is hosted in the United States. Our Site is not intended for use by and is not directed to residents of the European Union. All data is stored and processed in the United States. If you are attempting to access the Site from a physical location within the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please be advised that your use of the Site is governed by U.S. law and this Privacy Policy. To the extent you provide personal information through the Site, you are transferring your personal information to the United States, and you consent to:

  • such transfer,
  • the application of the laws of the United States and/or the State of New Jersey with respect to any dispute arising from, or related to, the Privacy Policy and/or your use of the Site, other than such rules, regulations, case law, and/or international treaties that would result in the application of the laws of a jurisdiction other than the United States or the State of New Jersey, and
  • the exclusive jurisdiction of the courts of the State of New Jersey and the federal courts sitting in New Jersey.

The Site, and the materials contained in the Site, are presented solely for the use of users located in the United States of America and its territories and possessions, excluding Puerto Rico, American Samoa, Guam, and the Virgin Islands. Guests who choose to visit the Site from outside of the United States of America are advised that this Privacy Policy does not necessarily comply with the privacy laws and regulations of the country from which you are accessing the Site. We therefore request that you do NOT provide personal information to us if you are accessing the Site from outside of the Unites States of America.

Any claim or dispute between you and USRowing that arises from your use of the Site or in connection with the Privacy Policy shall be decided exclusively by a court of competent jurisdiction located in New Jersey, U.S.A.

CHANGES TO THIS POLICY

USRowing reserves the right, at our discretion, to change, modify, add, or remove portions of this Privacy Policy at any time. Such changes, revisions, or modifications will be effective immediately upon notice to you, which may be given by any means including, without limitation, via posting on the Site. If the changes are significant, we will provide a more prominent notice. If USRowing changes this policy, site users have the choice to OPT-OUT following the OPT-OUT procedure listed below. Each version has an effective date listed at the top of the policy. Your continued use of the Site after such notice will be deemed to constitute acceptance of such changes, revisions or modifications. Please check this Privacy Policy periodically for changes.
